About

This blog reflects my perspective as a trial lawyer practicing in Missouri. It focuses on how Missouri law and practice work in the real world—through appellate decisions, statutory changes, the day‑to‑day pressures of litigation as well as a lawyer’s approach and experience.

The subject matter centers on personal injury and insurance cases, including liability, damages, coverage disputes, and bad‑faith claims. But the goal is not to restate the law. It is to examine how those developments operate in practice—how rules, doctrines, and procedures actually work when they are put into motion in a contested case.

Much of what appears here is not just a summary of decisions, but my take on what they mean and how they fit together. That includes where opinions move the law, where they create tension or opportunity, and how different pieces of a case—facts, proof, procedure, and timing—interact in ways that are not always obvious from the text of a rule or opinion. Litigation is rarely about isolated issues; it is about how those issues combine and unfold over time.

At times, the focus will be on that intersection—the mechanics of building and presenting a case, how legal principles translate into proof, and how outcomes are shaped by the way the pieces are assembled. There is an element of judgment in that process that doesn’t show up in reported decisions but matters just as much in practice.

This is not a consumer-oriented site. It is written for lawyers practicing in Missouri, particularly those handling injury and insurance matters from the plaintiff side. Although, I hope it is useful to all attorneys who practice in these areas or want to learn about them.

Posts are intended to be direct and usable. The focus is on identifying what matters, explaining why it matters, and providing analysis that can be applied in evaluating, developing, and trying a case. Where appropriate, I will also flag issues worth watching as the law continues to develop.

The goal is simple: to provide a reliable, efficient resource for Missouri practitioners—analysis grounded in actual practice, with enough clarity to be useful and enough perspective to make it worth your time.
